Louisville and those businesses are the Kentucky Derby and Churchill should think twice about its misguided freakout.

If you’re a blogger and you receive equipment, food, products and mention them in your writing? The FTC requires you to disclose the specifics. If you wear a t-shirt you receive from a restaurant in a photo? You’ve gotta make a disclosure. Yes, this means if you receive a free taste of coffee? It must be disclosed. Which would make sense, right? Folks in the entertainment or PR world would grasp the importance of knowing and understanding their audience, right? Nah, “Roni” responded by calling us a “douche.” Which you can call us if you’re giving us money but not when asking for it.

The entity isn’t registered with the Kentucky Secretary of State and its affiliate entity, Bluegrass Art Experience, isn’t either. That’s despite giving the impression on their websites that they’re non-profit and give funds to charity.

So, way to go, Churchill Downs. You threaten longtime local businesses with legal action for daring mention “Derby” in their annual events. But willingly allow “Churchill Downs” to be used by people spreading nasty ass remarks among the press while asking for money under the guise of supporting charity. During your Memorial Day $100,000 handicap race, no less.

We’re a fan and supporter of the arts in Louisville and Kentucky. But hypocrisy, less than transparent charitable practices and shitty attitudes aren’t the way to conduct business in this town. Louisville has manners, respect and decency. Churchill Downs ought to start acting like it.
