Yup.
In a complete turnabout, the Family Foundation of Kentucky has decided to challenge Instant Racing at the Court of Appeals level instead of allowing their appeal to go directly to the Kentucky Supreme Court.
Wait – it gets better:
The motion uses the following sentence concerning the effort to have the Supreme Court rule on the issue: “The movants are attempting to slip daylight past the rooster.”
